Is It Legal to Download Instagram, TikTok and YouTube Videos?

Short answer: downloading a public video for personal, offline viewing is generally tolerated, but re-uploading, selling or claiming someone else's content is copyright infringement. The platforms' own terms are stricter than the law in some places.

This article is general information, not legal advice. Laws differ by country.

Three separate questions

When people ask "is it legal?", they're really asking three different things:

  1. Copyright law: who owns the video and what you're allowed to do with it.
  2. Platform terms: the rules you agreed to when you made an account.
  3. Privacy: whether saving someone's content intrudes on them.

1. Copyright: it's about what you do with it

The creator owns the copyright to their video. Copyright mainly controls copying and distributing:

What you do Generally
Save a public video to watch later yourself Usually fine / low risk
Save your own videos ✅ Fine, it's yours
Save royalty-free or Creative Commons content ✅ Fine (follow the licence)
Use a short clip for commentary, review or education Often allowed under fair use / fair dealing (depends on country)
Re-upload it to your own account ❌ Infringement without permission
Use it in ads or sell it ❌ Infringement without a licence

2. Platform terms

  • YouTube's terms say you shouldn't download content unless YouTube shows a download button or link (e.g. Premium offline), or you have the owner's permission.
  • Instagram, TikTok, Facebook and Snapchat prohibit collecting content in ways not offered by the app, and repost rules require credit or permission.

Breaking terms of service is a contract matter, not a crime, but platforms can restrict accounts that repost content.

3. Privacy and respect

Public doesn't mean "free for any use". Saving a stranger's Story to mock or harass them can break harassment and privacy laws, and it's simply wrong. Use downloads for yourself: inspiration, offline viewing, keeping your own memories.

How to stay on the safe side

  • ✅ Download public content for personal use
  • ✅ Ask permission before reposting, and credit the creator
  • ✅ Prefer your own videos and royalty-free libraries for anything public or commercial
  • ❌ Don't remove watermarks to pass off content as yours
  • ❌ Don't sell or monetise other people's videos
